                            Duplication of Benefits -A Clarification

It has been observed that Regional Offices by and large misinterpret Section-28 of the EOB Act 1976 and refuse pension to legitimate claimant. The B&C Department has received references seeking clarification regarding issuance of survivor/old age pension where the spouse was already in receipt of a pension in his/her own right under the provisions of the EOB Act, 1976. The Regions have  sought guidance on

  1. Whether Survivor’s pension could be awarded to the spouse who is already in receipt of entitled for old-age pension/grant at the same time.

  2. Whether this would tantamount to “Duplication of Benefits” under Section 28 of the EOB Act, 1976.

2. The issue has been discussed threadbare in consultation with the Law Department. It is clarified for the guidance of all the Regional Offices that any  spouse can get survivor/old age pension/grant in addition to his/her own pension/grant provided that both husband and wife were separately registered as Insured Persons under the EOB Act, 1976 and fulfilled conditions laid down for entitlement of any benefits under the EOB Act, 1976.
