EOB Act 1976 was promulgated for the benefit of persons employed in industrial, commercial and other organizations and matters connected therewith. Section 11 of the Act requires that every employer shall get itself and its employees registered with EOBI before expiry of thirty days from the date the Act becomes applicable on it. 2. To facilitate the communication of regional offices with employers for registration of establishments, Circular No. 08/2002-03 was issued which standardized the letter formats to be used in this regard. However it has been noted that neither the instructions are being followed nor the delivery of the letters is being ensured, especially in cases which warrant suo motu registration. Employers usually take the plea that they were registered without informing them about the applicability of the Act. They also dispute payment of contributions retrospectively. In such cases Regional Offices fail to defend their cases under Sections 33, 34 and 35 of the Act. 3. It has therefore been decided that where the beat officer is sure of the applicability of the Act but the employer is reluctant to sign PR-01 for registration, letter and reminders at Annex I to III shall be sent through Courier as well as Registered A.D Post. The Regional Head shall also check delivery of these letters on phone and place the receipts in the respective files. 4. In such cases if an employer challenges the availability of any correspondence prior to registration under Sections 33,34 and 35 of the Act and the regional office fails to prove its case, the Regional Head shall be held responsible. 5. It issues with the approval of Chairman and supersedes Circular No 08/2002 dated 17-07-2002.
